This TTS Roblox SFX Library End User License Agreement (“EULA”) is a legal agreement between You (either an individual or a single entity) and Tommy Tallarico Studios, Inc. (“TTS”) for the TTS Roblox Sound FX Library. You have licensed which includes the following: (i) designed sound effects, (ii) source sound files and (iii) any printed, "online" or electronic documentation (collectively, the “TTS Roblox SFX”). By licensing, copying or otherwise using the TTS Roblox SFX, You agree to be bound by the terms of this EULA.
If You do not agree to the terms of this EULA, do not purchase or use the TTS Roblox SFX.
Both US and international copyright laws, as well as other intellectual property laws and treaties, protect the TTS Roblox SFX. All rights not expressly granted to You hereunder are reserved by TTS.
Grant of License:
In consideration of the license fee paid by You, TTS grants a non-exclusive “MEDIA LICENSE” to You. All TTS Roblox SFX are licensed, not sold, to You by TTS for commercial and non-commercial use in music, sound-effect, audio/video post-production, performance, and/or broadcast solely for the Roblox platform and limited, related ancillary uses as described below.
The MEDIA LICENSE for this product is granted only to a single user. The rights granted herein are non-transferable and may not be assigned by you to any party.
While credits are greatly appreciated, the MEDIA LICENSE does not require you to provide source attribution to TTS.
The MEDIA LICENSE includes:
1. Mechanical rights
The non-exclusive right to re-record, duplicate and release the TTS Roblox SFX as part of Your product/production solely for the Roblox platform as well as derivative works of such Roblox product/production (i.e. video tape, film, digital video of your Roblox product/production). This license does not include the right to resell the TTS Roblox SFX as a standalone product in whole or in part or to utilize the TTS Roblox SFX as part of any product/production to be released on any other interactive entertainment (video game) platform, including ports of products/productions originally released on Roblox.
2. Synchronization rights
The non-exclusive right to use the TTS Roblox SFX as a soundtrack “synched” with visual images or sounds as part of Your Roblox product/production.
3. Public Performance Broadcast rights
The non-exlusive right to use the TTS Roblox SFX as part of the public viewing or broadcast of Your Roblox product/production, including but not limited to videos, web sites, podcasts, multimedia presentations, films, television, and radio.
The MEDIA LICENSE is granted worldwide and in perpetuity.
License Limitations:
Copyright infringement is a serious offence. TTS protects its copyright by all necessary means, including legal action. The MEDIA LICENSE granted herein does not authorize You to:
1) Include of the TTS Roblox SFX in any library (e.g. sample instrument, sound effects library, etc.) online or offline without TTS’ express written consent;
2) Re-distribution of the TTS Roblox SFX, through any means, including but not limited to, re-selling, trading, sharing, resampling, mixing, processing, isolating, or embedding into software or hardware of any kind, for the purpose of re-recording or reproduction as part of any free or commercial library of musical and/or sound effect samples and/or articulations, or any form of musical sample or sound effect sample playback system or device;
3) Copying, duplicating, providing access to, selling, leasing, loaning or giving away unsynchronized sounds from the TTS Roblox SFX by any means including the World Wide Web, streaming audio or any delivery method now known or which shall become known; or
4) Sharing your rights hereunder with, or assigning those rights to, any third party.
Limited Representations and Warranties:
TTS hereby represents and warrants that it has the power and authority to grant the rights and licenses granted to You under this EULA.
LIMITATION OF LIABILITY
Except as set forth above, the TTS Roblox SFX are licensed to You “as is” and your exclusive remedy and TTS’ entire liability for errors in the TTS Roblox SFX shall be limited, at TTS’ s option, to correction of the error, replacement of the TTS Roblox SFX or return of the applicable fees paid for the defective TTS Roblox SFX for the time period during which you are not able to utilize the TTS Roblox SFX under the terms of this Agreement.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TTS ON BEHALF OF ITSELF AND ITS LICENSORS, SUPPLIERS AND AFFILIATES, DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT WITH REGARD TO THE LICENSED TTS Roblox SFX. TTS DOES NOT WARRANT THAT THE LICENSED SOFTWARE WILL SATISFY YOUR REQUIREMENTS OR THAT IT WILL OPERATE WITHOUT DEFECT OR ERROR OR THAT THE OPERATION THEREOF WILL BE UNINTERRUPTED. EXCEPT AS EXPRESSLY PROVIDED ABOVE, IN NO EVENT SHALL TTS OR ANYONE AFFILIATED WITH TTS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE TTS Roblox SFX OR THE USE OR OTHER DEALINGS IN REGARD TO THE TTS Roblox SFX.
Downloaded TTS Roblox SFX cannot be returned, so we cannot and generally will not provide refunds. TTS may choose to do so at TSS’ own discretion, but please be aware that as soon as You have downloaded the TTS Roblox SFX, You cannot return it.
